Samsung, Hynix, Infineon settle DRAM price fixing suit

Samsung Electronics Co., Hynix Semiconductor Inc. and Infineon Technologies AG have reportedly agreed to pay fines totalling Rs.721.76 crore ($160 million) to resolve a class-action lawsuit alleging DRAM price fixing, according to a Bloomberg report.

Samsung agreed to pay Rs.302.24 crore ($67 million), Hynix will pay Rs.329.30 crore ($73 million) and Infineon Rs.90.22 crore ($20 million), according to the report, which cited a lawyer representing plaintiffs in the case, computer industry sources and other DRAM customers.

Over the past two years, Samsung, Hynix and Infineon have all pleaded guilty to charges of DRAM price fixing stemming from an investigation by the U.S. Justice Department. Samsung agreed to pay Rs.1,353.30 crore ($300 million) in fines in November 2005, Hynix agreed to pay Rs.834.54 crore ($185 million) in fines in April 2005 and Infineon agreed to pay Rs.721.76 crore ($160 million) in fines in 2004.

Executives from all three companies have also agreed to pay fines and serve jail sentences of up to eight months.

Attorneys for several plaintiffs in the case, Internet Integration Inc. versus Micron Technology Inc. et al, could not be reached for comment.

U.S. District Court Judge Phyllis J. Hamilton granted preliminary approval of the settlements with Samsung and Infineon, according to court documents. A pending motion for the preliminary approval of the settlement with Hynix is scheduled for May 17, according to the documents.

Micron is also named in the class-action suit. No settlement with Micron has been reached, according to court documents. Micron agreed in 2003 to cooperate with the DoJ's price-fixing investigation and has thus far not been fined by the government.
